該機構在 8 月宣布，如果煙草和薄荷醇以外的口味產品的 PMTA不包含足夠的特定產品科學證據來證明對成年吸煙者有足夠的好處，可以克服對青少年構成的風險，那么它們將被拒絕。
許多獲得 MDO 的公司還有其他產品，主要包括煙草和薄荷味的電子煙油，該機構仍在考慮使用 PMTA 進行市場授權，但收到 MDO 并不意味著公司將關閉。
PMTA 被拒絕的產品必須從市場上撤下，否則制造商和銷售商可能會受到 FDA 的進一步執法。
美國食品和藥物管理局昨天表示，沒有申請未決的產品，包括例如那些有營銷拒絕令的產品和沒有提交申請的產品，是我們的最高執法優先事項。
然而，FDA 承認，實際上，我們無法對每一種非法銷售的煙草產品采取執法行動，我們需要充分利用該機構的資源。
許多電子煙油制造商表示，他們將繼續銷售用合成尼古丁重新配制的調味產品，這是一個合法的灰色地帶。
FDA 尚未嘗試對合成尼古丁產品采取行動，在其目前的授權下可能無法采取行動。
